Mock Employment Tribunal a huge success!
The Mock Employment Tribunal, staged jointly by AM Legal and Irwin Mitchell Solicitors with kind help from Number 5 Chambers, proves a huge success as the claimant succeeds with her claim for unfair dismissal.
The Tribunal, which took place in a fittingly impressive courtroom at the Priory Rooms in Birmingham, was very well attended with over 85 HR professionals and Directors taking the time out of their day to see the barristers and solicitors of Number 5 Chambers and Irwin Mitchell Solicitors re-enact a real unfair dismissal case from 2007.
The claimant, a used car sales-woman (very adeptly acted by one of Irwin Mitchell’s solicitors), argued that the lack of clear policy regarding internet usage in office hours meant that her dismissal for accessing lewd websites at lunchtimes was unfair.
The respondent claimed that the actions of the dismissed employee portrayed the company in a bad light and grossly overstepped the lines of taste and decency.
However in his summation the judge ruled in favour of the claimant citing an unacceptably vague internet policy which failed to define clear guidelines on acceptable internet usage. The twist then came when the judge found the claimant jointly culpable to her own dismissal and thus awarded only 50% of the claimed damages.
